General damages

How is compensation calculated for multiple injuries?

Will anything be deducted from my compensation award?

- The cost of the After the Event (ATE) insurance premium, if you opted for it;

Will anything be added to my compensation?

However, your solicitor will be entitled to a success fee of up to 25% of certain parts of your compensation if you win. To offset the impact of this success fee, your award for general damages will be increased by 10%.

How much could I claim if I lost a loved one in a car accident?
If you have lost a loved one in a fatal accident caused by someone else’s negligence and you qualify as their dependent, you can make a claim under the Fatal Accident Act 1976. Under this Act, you will be entitled to claim:
- The loss of financial support expected from your loved one – this will be calculated by adding up their salary and other sources of income and deducting a percentage they would have likely spent on themselves (such as 35%). The remaining 65%, known as the multiplicand, will be multiplied by the number of years you would have been financially dependent on them and adjusted based on factors such as their age.
- The loss of services they provided, such as childcare and DIY projects – this part of the compensation is more difficult to calculate, and it will usually involve referencing average local rates for these services.
- Funeral expenses, such as the cost of a memorial or transporting the body to the grave – these are calculated based on financial evidence like receipts and invoices.
- Compensation for your loved one’s pain and suffering if they did not die immediately – the amount will depend on the severity of their pain and suffering and how long they were alive after the accident.
- Financial losses and expenses incurred by your loved one between the accident and passing away – this will be calculated based on evidence such as receipts, payslips and medical bills.
- You may also be entitled to claim a bereavement award of £15,120 for the grief and suffering caused by the loss of your loved one.
